1. Provider and Scope
The provider of the "Fintraq" app is Andre Neubert, Mainz, Germany (contact: contact@andreneubert.com). Further provider details can be found in the Impressum. These Terms of Use apply to the use of the app on iOS and Android. If you obtain the app via the Apple App Store, Apple's standard Licensed Application End User License Agreement (Apple Standard EULA) applies in addition; if you obtain it via Google Play, the Google Play Terms of Service apply in addition.
2. Scope of the Free Version
Fintraq provides local personal finance planning. The data you enter is stored exclusively locally on your device; there is no user account and no synchronization of that data to a server. To improve the app, usage counters containing no financial data are transmitted, each with a random identifier for your app installation; they can be switched off in the app (see Privacy).
3. Fintraq Plus (In-App Subscription)
Fintraq Plus is an optional auto-renewing subscription (1 month or 1 year) and includes exactly the following features:
- loan calculator,
- before-after comparison when saving plan changes,
- adding new "pay in 30 days" purchases (invoice and BNPL purchases) including their automatic scheduling in the monthly plan,
- the full analysis of your financial history (monthly trends, spending categories, budgets, fixed costs, loans and interest, savings goals, and CSV and report exports; the core overview with totals and monthly averages remains available without a subscription),
- ad-free use of the app.
Also included are bug fixes, security updates, and other updates required to provide these features as contractually agreed (Section 327f of the German Civil Code, BGB).
4. Future Features
Fintraq is continuously being developed. New features that go beyond the scope described in Section 3 may be offered as separate purchases or in a separate, higher product tier. There is no entitlement to future additional features. Plus features already purchased remain unaffected; paid features will not be removed or materially restricted for active subscriptions.
5. Conclusion of Contract, Prices, Renewal, Cancellation
The subscription is purchased and billed through the app store you use. The purchase dialog identifies the contracting party and sets out the price for the relevant storefront, together with the applicable tax and payment information.
The subscription renews automatically for the selected term unless it is cancelled in the subscription settings of the respective store before the end of the current term. Cancellation is possible at any time, effective at the end of the current term. Deleting the app does not cancel the subscription.
If a free trial is offered, it is available only when subscribing for the first time. After it ends, it automatically converts into the paid subscription unless it is cancelled in the subscription settings of the respective store before the end of the trial period.
When the subscription ends, the Plus features listed in Section 3 are no longer available; ad-free use ends accordingly and ads are shown again. The data you have entered in the app remains unaffected and fully intact. Subscribing again unlocks the Plus features once more.
6. Withdrawal and Refunds
Any withdrawal or refund request must be submitted through the relevant store and will be handled in accordance with that store's terms. Mandatory statutory rights remain unaffected.
7. No Financial Advice
Fintraq is a planning tool. The app does not provide investment, tax, or other financial advice; all calculations are for orientation purposes only.
8. Liability
Andre Neubert is liable without limitation for intent and gross negligence as well as for damages resulting from injury to life, body, or health. In cases of ordinary negligence, liability exists only for the breach of essential contractual obligations (obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely), limited to the foreseeable damage typical for this type of contract. Liability under the German Product Liability Act remains unaffected.
9. Provisions for App Store Distribution
The following provisions apply if you obtain the app via the Apple App Store or Google Play; individual paragraphs expressly apply only to distribution via the Apple App Store.
Parties. These Terms of Use are concluded solely between you and Andre Neubert, not with Apple Inc. or Google LLC. Andre Neubert, not Apple or Google, is solely responsible for the app and its content.
License. You are granted a non-transferable license to use the app: if obtained via the Apple App Store, on Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions (including access by other accounts via Family Sharing); if obtained via Google Play, as permitted by the Google Play Terms of Service.
Maintenance and support. Andre Neubert is solely responsible for maintenance and support to the extent provided in these Terms or required by applicable law. Apple and Google have no obligation whatsoever to furnish any maintenance and support services with respect to the app.
Warranty. Andre Neubert is solely responsible for the statutory warranty. If the app was obtained via the Apple App Store, the following applies in addition: in the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the app; any other claims attributable to any failure to conform to a warranty are the sole responsibility of Andre Neubert. Your statutory rights, including Section 8, remain unaffected.
Product and legal claims. Andre Neubert, not Apple or Google, is responsible for addressing any claims by you or any third party relating to the app or your possession and use of it, including, but not limited to, (i) product liability claims, (ii) any claim that the app fails to conform to any applicable legal or regulatory requirement, and (iii) claims arising under consumer protection, privacy, or similar legislation.
Intellectual property rights. In the event of any third-party claim that the app or your possession and use of the app infringes that third party's intellectual property rights, Andre Neubert – not Apple or Google – is solely responsible for the investigation, defense, settlement, and discharge of any such claim.
Legal compliance and export control. You represent and warrant that you are not located in a country that is subject to a United States Government embargo or that has been designated by the United States Government as a "terrorist supporting" country, and that you are not listed on any United States Government list of prohibited or restricted parties.
Third-party terms. You must comply with applicable third-party terms of agreement when using the app, such as your wireless data service agreement.
Third-party beneficiary. If the app was obtained via the Apple App Store, Apple and Apple's subsidiaries are third-party beneficiaries of these Terms of Use. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

10. Final Provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods; mandatory consumer protection provisions of the country of your habitual residence remain unaffected. These Terms of Use may be updated if Fintraq or legal requirements change; the current version is available at this URL.
